The defendant in error, who will hereinafter be referred to as plaintiff, and the plaintiff in error, who will hereinafter be referred to as defendant, entered into a written executory contract for the sale and purchase of certain lots in Shawnee, Okla., which properly consisted of small business buildings with a wagon yard in the rear. The contract provided for $1,100' in cash and certain deferred payments, which were evidenced by 12 notes of $108 each, the first one due on May 1, 1924, and one due on the first day of each succeeding month until the 12 notes were paid.
