Appellant, being in the custody of the United States Marshal for the District of. Massachusetts, under an indictment found in that district for a violation of the Act of May 30, 1908, c. 234, 35 Stat. 554, now §§ 232-235 of the Criminal Code, c. 321, 35 Stat. 1088, 1134, in unlawfully transporting explosives from New York through Massachusetts to Yanceboro, Maine, petitioned the District Court for a writ of habeas corpus upon the ground that the order of commitment was. in violation of his rights under the Constitution and laws…
