OPINION

BASKIR, Chief Judge.

This case is one of more than 120 Winstarrelated cases arising out of the saving and loan crisis in the 1980’s. The history behind the thrift industry’s crisis and the subsequent measures taken by the Government to resolve it, have been extensively discussed in the original Winstar cases. See United States v. Winstar Corp., 518 U.S. 839, 116 S.Ct. 2432, 135 L.Ed.2d 964 (1996) (Winstar IV), aff'g, 64 F.3d 1531 (Fed.Cir.1995) (en banc) (Winstar III).
