The indictment charged the defendant with perjury in the malting of a false affidavit used upon a motion to open a default in a civil action. The action in which the default occurred was in the supreme court, in Monroe county. This action was founded upon a promissory note for $2,000 made by the defendant, and payable to the order of the plaintiff therein, Annie M. Keating. In the affidavit charged to be false, the defendant stated that he never gave Annie M. Keating a note, or ever had occasion to give her one; that he had never seen the note for $2,000, upon which her action was based, and…
