Appeal from court,of sessions, Orange county. John A. Williams was convicted of the crime of perjury, and front the judgment of conviction, and from an order denying a motion for a new trial on the minutes, and from an order denying a motion in arrest of judgment, defendant appeals.

1Per curiam

The sufficiency of the indictment in this case-presents an important question, and was the one most persistently urged on the argument by the appellant as a ground for the reversal, of the judgment. In the indictment it was, in effect, alleged that the defendant willfully, knowingly, and corruptly made oath before-an officer authorized to administer the same that a certain affidavit by him subscribed was true, and that the affidavit was made and entitled in an action in the supreme court. The statements contained in the affidavit were then set forth, and it was alleged that they were false.…
