Kimball, Justice.

The defendants, Robert Espy and Mike Chapman, charged with murder in the first degree in killing William Bears, were found guilty of murder in the second degree, and bring the case here for review by proceeding in error.

The killing occurred on September 11, 1937, at the small town of Arvada, Sheridan County, where several hundred persons were present to enjoy games, dancing and a barbecue. There was dancing on two dance floors, one at the Community Hall, and the other a short distance away in the open air. Joe Geiger was “master of ceremonies” in charge of the entertainment.…
