Plaintiffs Glovaroma, Inc. (“Glovaro-ma”), the Zappa Family Trust (the “Trust”), and Gail Zappa allege that Mal-jack Productions, Inc. (“MPI”) violated the Copyright Act, 17 U.S.C. §§ 101-1332, and the Trademark Act, 15 U.S.C. §§ 1051-1127. Plaintiffs also have a claim for an accounting. Both parties now move the court for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. For the reasons set forth below, the court denies plaintiffs’ motion for summary judgment but grants defendant’s motion for summary…
