Appeal by the plaintiff, the Adams Laundry Machinery Company, from an order of the Supreme Court, made at the Saratoga Special Term and entered in the office of the clerk of the county of Schenectady on the 23d day of January, 1913, retaxing the respondent’s costs herein, and amending the judgment theretofore entered herein accordingly.

Smith, P. J.:

Defendant recovered a judgment against the plaintiff upon a counterclaim in an action tried in the Supreme Court. Plaintiff’s motion for a new trial was denied; an appeal was taken to this court in March, 1912, from such order of denial and from the judgment entered herein. (See 153 App. Div. 930.)

Each party ordered a copy of the stenographer’s minutes, *154plaintiff receiving its copy April eighth. May 15, 1912, plaintiff’s attorney served a proposed case and exceptions upon defendant’s attorneys, and at the same time tendered the use of plaintiff’s copy of the minutes to the…
