MEMORANDUM OPINION AND ORDER
ASPEN, District Judge:
In June 1989, Dr. Edmund J. Lewis, individually and as a Trustee for Edmund J. Lewis, M.D. & Associates, S.C. defined Benefit Pension Trust (“Lewis Trust”), Edmund J. Lewis, M.D. & Associates, S.C., and the American Medical Supply Corporation (hereafter collectively referred to as “Lewis”) brought this multi-count action against Richard C. Hermann, R.C.
