MEMORANDUM AND ORDER

BECHTLE, District Judge.

Presently before the court are plaintiff’s motions for class certification pursuant to Fed.R.Civ.P. 23(a) and (b)(3) and to compel the production of documents which defendants claim are protected by the attorney-client privilege. For the reasons set forth herein, plaintiff’s motion for class certification will be granted as to counts I and III, *627and denied as to count II. In addition, plaintiffs motion to compel will be denied as to defendant E.F. Hutton Group, Inc., and granted as to defendants Lopp, Rittereiser, Fomon and Pierce insofar as these…
