This is an appeal by Charles F. Binder (Licensee) from an order of the Court of Common Pleas of Delaware County sustaining an action by the Department of Transportation (DOT) wherein DOT suspended for twelve months Licensees operating privileges for failure to submit to a breathalyzer examination pursuant to Section 1547(b) of the Vehicle Code, 75 Pa. C. S. §1547(b) (Code).

The trial court found that Licensee was lawfully arrested in Philadelphia and charged with driving while under the influence of alcohol on January 20, 1984. He was requested to submit to a breathalyzer…
