INDICTMENT against Hunch Hullen, beard by Judge R. B. Peebles and a jury, at March Term, 1903, of the Superior Court of New Hanovee County. From a verdict of guilty and judgment thereon the defendant appealed.

The defendant was indicted for breaking and entering the house of the prosecutor and stealing a watch therefrom. There were two counts in the bill, one for breaking and entering with intent to steal the goods and chattels of the prosecutor and the other for breaking and entering with intent to steal his goods and chattels, and actually stealing from the said house one watch, the property of prosecutor’s daughter.
The evidence tended to establish the following facts: That the prosecutor’s house was entered on January 19, 1903, about the dinner hour, and several articles were taken and carried…
