This action was brought by Sam S. Cutaia, appellee, against The Members Mutual Insurance Company, appellant, to recover on a policy of automobile liability insurance issued to William Smith. Cutaia had previously obtained judgment against Smith as a result of an automobile accident in which these two parties were involved. Appellee Cutaia thereafter brought the instant action against appellant, Members Mutual Insurance Company, on the automobile liability policy which had been issued to William Smith.
