This matter involves the appeal of a judgment of the Court of Claims which sustained the motion of the director of the Department of Transportation of Ohio, a defendant, to dismiss the complaint on the basis that the court lacked subject matter jurisdiction, and that the complaint failed to state a claim upon which relief could be granted. The facts in brief upon which the complaint was filed in the Court of Claims and which have given rise to this appeal are as follows.
