This is a suit in which the plaintiff, John L. Burns, Inc. [Burns] sued defendant Gulf Oil Corporation [Gulf] for $23,329.33 representing an amount of Georgia motor fuel tax paid by plaintiff Burns to defendant Gulf as part of the purchase price of fuel. Plaintiff Burns is a highway contractor. Defendant Gulf is a distributor of motor fuels.
