MEMORANDUM AND ORDER

KOPF, District Judge.

This matter is before the court on the petitioner’s pro se statement of appeal (filing 15) from an order that was entered by Magistrate Judge Gossett on April 7, 2004 (filing 12), permitting the respondent to file a limited response to the petition for writ of habeas corpus. Upon careful review of the court file, and after considering the arguments made and authorities cited in petitioner’s brief (filing 16), 1 I conclude that the order should be-sustained because it is neither clearly erroneous nor contrary to law.
