The policy of life insurance on which this action has proceeded was issued by the defendant on the 21st of May, 1886, insuring the life of Anton ICabok in the amount of $5,000. The insurance was effected for the benefit of his wife, the plaintiff in this action. He died on the 12th of August, 1886, and after supplying to the defendant the necessary proofs of death, and the expiration of the time limited for payment, and the defendant’s refusal to pay, this action was brought for the amount mentioned in the policy.
