This suit is based on a contract between plaintiff-Miller Brothers (Miller)1 and defendant-United States Department of Housing and Urban Development (HUD) for the servicing of mobile homes in Plaquemines Parish,2 Louisiana. Plaintiff claims that the Government improperly withheld money due under the contract. Defendant counterclaims, stating (1) that it overpaid on sums already remitted to plaintiff, (2) that Miller’s claim is forfeit due to fraud,3 and (3) that Miller, in the course of performing the contract, violated the False Claims Act.4 The Government *62further requests the statutory…
