The City of Jacksonville (“City”) originally brought this action in a Florida state court against the United States Department of the Navy (“Navy”) alleging past violations of state and local air pollution control laws enacted pursuant to the Federal Clean Air Act, 42 U.S.C. §§ 7401-7671(q) (“CAA”) and seeking punitive penalties for these past offenses. The Navy removed the case to federal district court pursuant to 28 U.S.C. § 1442(a)(1), and the district court denied the City’s motion to remand.
