The Indian River State Bank, a corporation, Joseph P. Brown, as Sheriff of Brevard County, *108and William Pritchett and Henry E. Pritchett, as partners, doing business under the firm name and style of Pritchett,,Bros., as plaintiffs, brought an action at law upon an injunction bond against the Baker & Holmes Company, a corporation, as defendant. As is disclosed by the transcript, on the 12th day of July, 1910, a preacipe for summons ad respondendum was filed, and on the same day the following affidavit:
