This case is before the court on Defendant O’Reilly Automotive Stores’s (“Defendant”) Motion for Summary Judgment (# 57) on its Amended Counterclaims (# 26). The underlying case is a contract dispute. While Plaintiff All Star Championship Racing’s (“Plaintiff’) claims are still being litigated and are proceeding independently, Defendant has filed five counterclaims.
