Chas. T. Hebard sued A. H. Baughman in the court below to recover a judgment for a definite sum of money alleged to'be due him upon the final settlement of the partnership relation theretofore existing between them. It was claimed in the petition here that the parties had made a settlement of the partnership affairs, and had definitely agreed as to the amount; of money due the defendant in error and to recover which a judgment was sought in this action.
