NEIGHBORS, Justice.

The People have appealed the decision of the district court denying their request to file a direct information. We affirm the trial court.

The procedural history of this case is as follows: The defendant was charged with criminal attempt to commit sexual assault on a child in violation of section 18-2-101, C.R.S.1973 (1978 Repl.Vol. 8). The charge was made in a felony complaint filed in the county court. Following a preliminary hearing the charge was dismissed.
