On December 3, 1973, Randolph Phillips, a resident of New York, mailed to counsel herein and to the Clerk a motion under Rule 60(b), F.R.Civ.P., grounds (1), (2) and (3),1 for an order granting him relief from the final judgment herein, signed on November 30, 1972, and entered on December 4, 1972. That judgment approved and confirmed the settlement of the M.D.L. 55 class actions and the plan of distribution, and barred the prosecution against the defendants in the class actions or anyone else of all settled claims by any member of the M. D.L. 55 classes,…
