The appellee-plaintiff was one year of age when the instant tort action was instituted against the corporation which operated a day care center and the director of that center. Appellee’s complaint alleged that he had been spanked by the appellant-defendant Mrs. Davis, who is the center’s director, and that this spanking “amounted to an assault and battery . . . .” The asserted liability of appellant-defendant A Child’s World, Inc. was premised upon the theory of respondeat superior.
