This action involves a claim by defendant in error, an oil and gas property and lease broker, for payment of a “reasonable” commission or “finder’s fee” allegedly owed him by plaintiff in error as a result of an oil company merger which he contends was brought about through his efforts. The case was tried to the court without a jury. The parties will be referred to as they were in the trial court, ie., plaintiff in error as Consolidated or defendant, and defendant in error as Roberts or plaintiff.
