Respondent moves to dismiss the appeal in this ease on the following facts:
On the sixth day of May, 1880, judgment in favor of plaintiff was entered in the Superior Court of the City and County of San Francisco, and on the thirteenth day of August of the same year an order was made denying defendant’s motion for a new trial. On the thirtieth day of August notice of appeal to the Supreme Court was served on the respondent, and on the eighteenth day of September *517the notice was filed in the office of the Clerk of the Superior Court.
