This is an appeal from a judgment of the district court of Oklahoma county in favor ,of the defendant in error, the defendant in the trial court,' against the plaintiff in error, the plaintiff in the trial court. The parties hereinafter will be referred to as they appeared in the trial court. The action was brought to cancel paving assessments against the property of the plaintiff.
