[¶ 1] Brandon Keller appeals a district court order dismissing his application for post-conviction relief. Keller argues his conspiracy to commit murder and attempted murder convictions are illegal because N.D.C.C. §§ 12.1-06-01 and 12.1-16-01(l)(b), attempted murder under circumstances manifesting an extreme indifference to the value of human life, and N.D.C.C. §§ 12.1-06-04 and 12.1-16-01(l)(b), conspiracy to commit murder under circumstances manifesting an extreme indifference to the value of human life, are incognizable offenses.
