Juanita Richardson, Robert Gower, Gloria Gower, and Joyce M. Smith, on behalf of themselves and all others similarly situated (collectively Plaintiffs), filed this action on 10 May 2002 against, inter alia, Bank of America, N.A. (Bank of America) and its wholly-owned subsidiary, NationsCredit Financial Services Corporation (Nations-' Credit) (collectively Defendants). 1 Plaintiffs alleged claims for unfair and deceptive trade practices (UDTP) under N.C.
