Claimant Harry A. Ness filed a petition in the Workers’ Compensation Court claiming a right to total permanent disability benefits from the date of his injury on October 14, 1981. Those benefits had been terminated and partial disability benefits commenced on December 8, 1982. Claimant’s case went to trial before a hearing examiner of the Workers’ Compensation Court on September 5, 1989, and the court’s findings of fact, conclusions of law, and judgment were entered on August 25,1990.
