Presently before this Court are the following two motions brought by defendants Duf-erco Ltd. (USA) (“Duferco USA”), Duferco Steel, Inc. (“Duferco Steel”), Duferco Trading Corp. (“Duferco Trading”), and Duferco Steel Sales, Ltd. (“Duferco Steel Sales”): (1) a motion to dismiss plaintiff Old Republic Insurance Co.’s (“ORIC” or “plaintiff’) Complaint for failure to state a claim upon which relief can be granted pursuant to Federal Rule of Civil Procedure (“Rule”) 12(b)(6); and (2) a motion to impose sanctions against plaintiff pursuant to Rule 11.
