Appeal from a judgment of the superior court for Okanogan county, Martin, J., entered May 18, 1903, upon a trial and conviction of the crime of manslaughter.

Durbar, J. —

On March 28, 1903, an information was filed by the prosecuting attorney of Okanogan county, charging defendant with murder in the first degree. On April 9 defendant was arraigned, and on April 10 his plea of not guilty was entered. He was brought to trial on the regular May term of said court, and upon the 15th day of May, 1903, the jury brought in a verdict finding him guilty of manslaughter. On May 18, 1903, he Was sentenced to the penitentiary for a term of four years. !From that judgment this appeal was taken.
