— On October 21, 1916, John Tormey died intestate in Bemhi county, leaving an estate situate *207therein consisting solely of mining property embracing eight undeveloped and unpatented mining claims, of which he was the original locator. William H. Shoup, of Lemhi county, who claimed to be a creditor of the deceased, filed in the probate court of said county a petition for appointment as administrator of the estate.
