| Daniel Marshall appeals his manslaughter conviction for the killing of Ronald Hodges, Jr.
Between him and his appellate counsel he assigns five errors. Because we conclude that the error they assigned about the trial judge’s denial of his motion for mistrial based upon the prosecutor’s cross-examination of him about his post-custody silence requires reversal of his conviction, we do not address the remaining assignments in the body of our opinion.1 At the trial, the prosecutor, over defense objection, cross-examined Mr. Marshall about invoking his right to remain silent…
