LILLIE, J.
After expressing a doubt as to defendant’s present sanity and suspending criminal proceedings, and after a sanity hearing wherein the issue was submitted on the reports of Doctors Myers, Davis and Deering, the trial judge found defendant to be presently insane and committed him to Atascadero State Hospital. Nine months later defendant was returned to court certified as able to stand trial; after a hearing the court found him to be presently sane and reinstated criminal proceedings.
