ROGERS, Justice.

Sam Gray was indicted and tried for murder and convicted of manslaughter. On appeal from his conviction and sentence, defendant presents two complaints which were unsuccessfully urged in the district court in a motion for a new trial.

Defendant’s first complaint is that the jury, during its deliberations, was in charge of Ernest Allen, who was not a duly-qualified deputy sheriff, and that therefore the jury was “subject to outside communication.” This complaint is not well founded.
