ROGERS, Justice.
Collie Saba, Israel Simmons, Cloyce Holloway, and Delmer Kennedy, young white men, were indicted for kidnapping Mary Brister, a young negro woman. The crime charged was “simple kidnapping” denounced by Article 45 of the Criminal Code. When the case was called for trial, Israel Simmons was overseas, serving in the armed forces, and could not be reached by legal process. The district attorney obtained a severance as to Collie Saba, whose trial was then proceeded with in pursuance to the assignment.
