Defendants Andre Shelby and Michael Capíes were charged by indictment with first degree murder (Ill. Rev. Stat. 1985, ch. 38, pars. 9 — 1(a)(1), (a)(2), (a)(3)) and burglary (Ill. Rev. Stat. 1985, ch. 38, par. 19 — 1(a)). Prior to trial, Shelby and Capíes each filed motions to quash arrest and suppress evidence on the grounds that their arrests were illegal, and motions to suppress statements on the grounds that their statements to police were not made voluntarily.
