On the 10th day of December, 1895, the General Assembly passed an act “to prohibit the sale of spirituous, alcoholic, malt, or intoxicating liquors within the incorporate limits of the town of DeSoto in Sumter county, to prescribe a penalty therefor, and for other purposes pertaining thereto. Acts of 1895, p. 213. The only question presented for determination in the present case is whether or not the above-mentioned act is constitutional.
