—In an action to recover damages for age discrimination, the defendant appeals from an order of the Supreme Court, Westchester County (Wood, J.), entered May 27, 1992, which denied its motion to dismiss the plaintiffs first cause of action asserted in the complaint pursuant to CPLR 3211 (a) (5).
Ordered that the order is reversed, on the law, with costs, the motion is granted, and the plaintiff’s first cause of action is dismissed.
