OPINION

McGREGOR, Judge.

Arnold Carrillo (Carrillo) appeals from the trial court’s order dismissing his 42 U.S.C. § 1983 (section 1983) action for failure to state a claim upon which relief can be granted. We conclude that the complaint failed to state a claim against defendants State of Arizona (the state) and the Arizona Department of Corrections (ADOC). We further conclude that the complaint states a claim against James Ricketts (Ricketts), former director of ADOC, in Ricketts’ personal capacity.
