In the view which we take of this case, it is unnecessary to decide whether or not the procedure followed by the trial court in permitting the amendment substituting as a party defendant the Florida Steel Corporation for Tri-State Culvert & Manufacturing Company was sufficient to circumvent the inhibition of Code § 81-1303, or whether or not the special demurrers to the portions of the answers of the defendants were properly sustained.
