Reversing.

The appellant, Sarah Day, a married woman of forty years of age, and who had been married to her husband, James Andrew Day, for nineteen or twenty years, and who had three children, one of whom was married at the time, was, together with one Bob Sparks, jointly, indicted in the Carter circuit court, and charged with the murder of her husband, James Andrew Day, by the administration to him, with the intent to murder him, of arsenic and other poisons, to the grand - jury unknown.
