OPINION OF THE COURT
PAPADAKOS, Justice.
This direct appeal arises from the conviction and death sentence of Henry P. Fahy (Appellant) pursuant to 42 Pa.C.S. § 9711(h).1 Appellant was arrested on January 29, *3011981, and charged with Murder of the First Degree,2 Rape,3 Burglary,4 and Possession of an Instrument of Crime5. The victim was twelve year old Nicoletta (“Nicky”) Caserta.
