BLACKBIRD, Justice.

In the action, out of which this appeal arose, defendants in error, partners in the ranching and cattle-raising business, obtained a general verdict and judgment in the amount of $17,000 against plaintiffs in error, as defendants, for injuries to some, and the death of other, cattle of their herd. In the *333present appeal by said defendants to reverse said judgment, 'both they and their adversaries will be referred to as they appeared in the trial court.
