This controversy involves four paramount questions, to-wit: (1) Was there clear and convincing proof of a mutual mistake between the parties to the deed from the Frates to Rimenik and Mendluwitz? (2) Was the deed from the Frates to the Fazios tantamount to a conveyance of that which the Frates had theretofore conveyed, and was such transaction so permeated with fraud, in contemplation of law, as to justify its - being held void?
