OPINION AND ORDER

SPRIZZO, District Judge:

Plaintiff Ajay P. Garg brings this action pursuant to the federal civil rights laws, 42 U.S.C. § 1981-1983 (1982) and the Fourth [sic] and Fourteenth Amendments of the United States Constitution. See Complaint at ¶ First. In this action plaintiff seeks a declaratory judgment that defendants violated “plaintiffs rights to equal educational opportunity and otherwise unconstitutionally effected [sic] his status as a citizen of the United States,” see id. at ¶ Second, and restitution of the rights, benefits and privileges of a graduate of the defendant…
