LOONEY, Justice.

E. M. Shivers and W. L. Garland, resident taxpayers in commissioners’ precinct No. 1, Van Zandt county, Tex., brought this suit against the commissioners’ court of said county and members of the court individually, the county judge, treasurer and auditor of the county, to review an order of said court (of April, 1931) distributing the Road and Bridge Fund of the county, and to enjoin defendants in their official capacity from distributing‘the fund in accordance with the order, alleging, in substance, that commissioners’ precinct No. 1, with the exception of precinct No. 4,…
