This suit was instituted by defendants in error, E. M. Shivers and W. L. Garland, resident taxpayers and citizens of Commissioners Precinct No. 1, Van Zandt County, Texas. They will be referred to as plaintiffs. The suit was against the County Judge, the Commissioners Court, the County Treasurer and the County Auditor of Van Zandt County.
